An order of protection from the court prohibits certain acts against you.
Dangerous, violent, or disturbing behaviors that the court can help protect
you from include:
- Domestic abuse
- Attempted assault
- Reckless endangerment
- Disorderly conduct
In cases of domestic violence, you can get an order of protection from a Family Court against a current
or former spouse, a person with whom you have had a child, a family member
that you are related to by blood or marriage, or someone with whom you
have had an intimate relationship.
How can an order protect me?
In an order of protection,
a judge can
demand the defendant to stop any abusive behavior, such as assault, menacing, stalking, or similar misconduct. The judge
can also order the defendant to be removed from your residence by law
enforcement and prohibit the defendant from contacting you at home, at
work, at school, or any other place you name, and from telephoning, sending
emails, or writing you letters.
Judges can also protect your children, such as giving you legal custody, ordering child support from the defendant,
and requiring any visitations between your children and the defendant
to be supervised. Those who violate orders of protection can be arrested,
given a jail sentence, be charged with a more serious crime, be prohibited
from owning guns, be required to pay for medical or other expenses caused
by the abuse, or be put on probation.
